BREAKING: USCIS Expected to Begin Requiring Online Filing

On August 10, 2026, USCIS announced its plan to introduce an Interim Final Rule that would require e-filing using the myUSCIS website for some immigration benefits.

Under the final rule, posted August 11, 2026, USCIS can now require e-filings for any immigration form that has already been available for e-filing for 180 days or more. For each form that is being moved to exclusive e-filing, USCIS will notify the public on its website at least 60 days before the e-filing requirement will take effect. 

Those who cannot use the e-filing system are able to request a waiver of the requirement. Waivers will be granted on a discretionary basis, looking at any undue hardship that would be caused by the e-filing requirement.

To prepare for e-filings, applicants should create a myUSCIS account if they do not already have one.
