New Versions of the Form I-539 and Form I-765 to be Required as of September 15, 2026

On September 15, 2026, U.S. Citizenship and Immigration Services will publish revised editions of Form I-539, Application to Extend/Change Nonimmigrant Status, and Form I-765, Application for Employment Authorization

The 09/15/26 editions of the forms will replace the existing versions. There will be no grace period in the switch over of the forms. This means that any Forms I-539 or Forms I-765 filed on or after September 15, 2026 MUST be filed with the 09/15/26 version of the form. Mail-in submissions must be postmarked before September 15, 2026 in order for the older version to be accepted.

USCIS has posted preview versions of the 09/15/26 editions of Form I-539 and Form I-765 with their instructions on each respective form's webpage. These preview versions are for review only and will NOT be accepted before September 15, 2026. 

Applicants should always check edition date at the bottom left of their forms before submitting. The USCIS webpage for each form can be used to verify the currently accepted edition.
